Terms of Sale
Last updated: [date of launch]
These terms apply when you buy Before Help Arrives™ products (the Family Emergency Playbook, the Quick-Reference Cards, the Family Readiness Kit, and any free downloads) from HSS (PTY) Ltd, trading as Healthcare Systems Solutions ("we", "us"). Contact details are on our Contact page.
1. Who you buy from
Our products are sold through Gumroad, which acts as the merchant of record. Gumroad takes your payment, issues your receipt, and charges and pays any sales tax or VAT due in your country. Gumroad's own terms also apply to the purchase: https://gumroad.com/terms.
2. What you get
- Digital files (PDF) for download, described on the product page. Nothing physical is shipped.
- Access is through your Gumroad receipt and library as soon as payment is confirmed.
- Updated editions of the product you bought (for example, after a guideline change), at no extra cost, for as long as we publish that edition.
3. Your licence
When you buy, we grant you a personal, non-transferable licence to use the files for yourself and the people in your household. You may print copies for your home, your car and your first aid kit, and share the Quick-Reference Cards with people who care for your household (for example a grandparent, babysitter or nanny).
You may not:
- resell, publish, upload or distribute the files, or share your download link;
- use the content to run paid training, or in a school, business or organisation, without a written licence from us (contact us for group and organisational licences);
- remove our name, copyright notice or disclaimers.
All content is © HSS (PTY) Ltd. Before Help Arrives™ is our trade mark.
4. Price and payment
The price shown on the product page is in US dollars. Gumroad may show it in your local currency, and adds any tax due before you pay. Discount codes can't be combined unless the code says so.
5. Refunds: our 30-day guarantee
If you aren't satisfied, ask for a refund within 30 days of purchase and you'll get one in full. See our Refund Policy. This guarantee is in addition to your legal rights.
6. Your right of withdrawal (EU, EEA and UK consumers)
Consumers in the EU, EEA and UK normally have 14 days to withdraw from an online purchase. For digital content, that right ends once the download starts, provided you have expressly agreed to immediate access and acknowledged that you lose the right. At checkout you give that consent by choosing to access the files straight away. Our 30-day money-back guarantee still applies in full, so in practice you can still get a refund for 30 days.
7. Medical disclaimer
Our products are educational and for preparedness only. They are not medical advice, diagnosis or treatment, and they don't replace emergency services or certified CPR and First Aid training. In an emergency, always call your local emergency number first and follow the call-taker. Please read our full Medical Disclaimer, which forms part of these terms.
8. Our liability
We take care to make our content accurate and up to date with published guidance at the time of writing, but guidance changes and every emergency is different.
- To the extent the law allows, we aren't liable for any loss arising from the use of, or reliance on, our content in an emergency or otherwise.
- Our total liability to you for any claim about a purchase is limited to the price you paid.
- Nothing in these terms limits liability that can't be limited by law, including your statutory rights as a consumer in your country, or liability for death or personal injury caused by our negligence.
9. Changes to these terms
We may update these terms from time to time. The version on our website when you buy applies to that purchase.
10. Law and disputes
These terms are governed by the laws of Botswana. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts. Please contact us first; most problems can be solved by email.
